Trustower Terms of Service

1. Legal Entity and Definitions

"Trustower" is the trade name of Trostower LLC, a Wyoming limited liability company (EIN: 61-2331400). By accessing and using Trustower, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our platform.

2. Fund Custody and Custodial Partners

Trostower LLC does not hold funds. Trostower LLC is a technology platform that manages deal lifecycle and controls when funds are released. All customer funds are held by licensed third-party custodial partners in segregated accounts. Trostower LLC is not a bank, financial institution, or money transmitter.

3. User Responsibilities

Users of Trustower agree to:

• Provide accurate, complete information during account creation
• Comply with KYC/AML identity verification requirements
• Use the platform only for legal purposes
• Not engage in fraud, manipulation, or deceptive practices
• Respect intellectual property and privacy of others
• Not attempt to circumvent security measures

4. Transaction Conditions

Transaction conditions must be:

• Clearly defined in writing by both parties
• Legal and not prohibited by these terms
• Measurable and verifiable
• Agreed to before payment is sent

5. Dispute Resolution Process

Disputes may be opened by either party during the inspection window. Trustower follows a standardized resolution process:

• Either party may open a dispute during the inspection window
• Funds are immediately frozen when a dispute is initiated
• Both parties have 72 hours to submit evidence
• Trustower reviews evidence and makes a binding determination within 5 business days
• Unresolved legal disputes are governed by the laws of Wyoming, USA

6. Fees and Payments

Trustower charges a platform fee on successful deal completions only:

• Fee structure: 1.5% of deal value
• Minimum fee: $5.00
• Maximum fee: $500.00
• When charged: Only on successful deal completions
• No charges: Cancelled or refunded deals incur no fee

7. Prohibited Transactions

Users are prohibited from using Trustower for transactions involving:

• Drugs or controlled substances
• Weapons or explosives
• Counterfeit goods
• Stolen property
• Money laundering or any illegal activity

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TROSTOWER LLC'S LIABILITY IS LIMITED TO THE PLATFORM FEE PAID ON THE RELEVANT TRANSACTION.

Trostower LLC shall not be liable for indirect, incidental, consequential damages, loss of profits, data, or business opportunities, actions of transaction counterparties, or third-party fraud.

9. Indemnification

Users agree to indemnify Trustower from claims, damages, and costs arising from:

• User violation of these terms
• User violation of applicable laws
• User infringement of third-party rights
• User transactions involving prohibited items

10. Modifications to Terms

Trustower reserves the right to modify these terms. Users will be notified of material changes. Continued use of the platform constitutes acceptance of updated terms.

11. Termination

Trustower may suspend or terminate accounts that:

• Violate these terms
• Engage in fraudulent or illegal activity
• Pose security or compliance risks
• Are inactive for extended periods

12. Governing Law

These terms and all related transactions are governed by the laws of the State of Wyoming, USA, without regard to conflict of law principles.
